("Act"). The Board found the Operator in violation of Section 34-32.5-116(4)(1) of the Act <br />for failing to protect areas outside of the affected land from slides or damage during <br />mining operations. The Board ordered the Operator to convert the Operator's existing <br />Section 110 permit into a Section 112 permit to include all affected lands within the new <br />permit by July 31, 2006. The Board ordered the Operator to post an interim reclamation <br />bond in an amount to be calculated by the Division. The Board assessed civil penalties <br />in the amount of $7,200.00, based on the rate of $100.00 per day for 72 days, with all but <br />$400.00 suspended if the Operator complied with the corrective actions in a timely <br />manner as specified herein. <br />4. The Board has jurisdiction over this matter pursuant to Sections 34-32.5-1,04, 34-32.5-105 <br />7 ~ <br />and 34-32.5-124 of the Act. <br /> <br />S. The Operator now requests additional time to convert his existing Section 110 permit into <br />a Section 112 permit, as required by the Board order. The Operator stated that he had <br />reached a tentative agreement to acquire the property that was the subject of the Board <br />order. He asserts that more time is needed to complete surveying at the site in order to <br />submit a complete permit conversion application to the Division. <br />6. The Division recommends approval of the extension request. <br />Because the Operator has requested an extension to allow additional time to complete <br />surveying and to submit an accurate permit conversion application and because the <br />Division agrees that an extension is warranted, it is appropriate for the Board to grant the <br />Operator's extension request. <br />ORDER <br />Based on the foregoing findings of fact and conclusions of law, the Board hereby grants the <br />Operator's request for a modification of the Board order to allow more time to convert the <br />
