The legal description of the structure: <br />Section 28, Township 3 North, Range 70 West, 6th p.M., <br />Boulder County. <br />4. The source of water: <br />I ~ <br />1 ~? <br />St. Vrain Creek via Swede Ditch, Boulder Feeder Canal, <br />Foothills Reservoir Feeder Canal and Smead Ditch. <br />5. The date of appropriation: <br />June 20, 1984 <br />6. The amount of water: <br />9,000 acre feet, CONDITIONAL <br />7. The use of the water: <br />Irrigation, municipal, industrial, flood control, water <br />quality control. recreation, fishery enhancement, minimum stream flows, <br />exchange and replacement. <br />8. Water shall not be impounded, except pursuant to the <br />operation of a lawful exchange, unless entitled to do so by virtue of <br />the priority herein awarded. At all other times, all inflow of water <br />into the reservoir from any source, including precipitation, shall be <br />removed by applicant or applicant's successors in interest by draining, <br />pumping or other means, and released into the nearest natural <br />watercourse or below the reservoir, and not utilized by applicant or <br />applicant's successors in interest in any manner. Applicant shall <br />install and maintain such meters, measuring devices or other structures <br />as may be required by the Division Engineer of Water Division No. 1. <br />/-'` 9. This structure is the limestone quarry pits where <br />~' excavation was started in 1967. No evidence of intent to store water <br />for the uses listed in paragraph 7 was evidenced until 1984. <br />
