The letter is in regard to an
alternate access route to the 124` Estates site from 120`s Avenue. The Division notified the
operator that the construction of a new access route would need to be filed with the Division as
a Perrnit Amendment Application because it will increase the acreage of the affected land as
defined by Rule 1.1(3) of the Construction Materials Rules & Regulations,
The Division is aware of the constraints of the Operator and the City of Brighton regazding
access to the site in order to begin the mining operation. The Division will review the
application in an expeditiously manner within the limits of the Colorado Land Reclamation Act
for the Extraction of Construction Materials and the Rules and Regulations.
If you have any questions regazding this process, please do not hesitate to contact Erica Crosby
or me at 303-866-3567.
S/incerely,~j / ~
Bruce Humphries
Minerals Program Supervisor
STATE OF COLORADO
D I V[ S[ O N O F
MINERALS
GEOLOGY
RECLAMATION
MINING•SAFETY
Bill Ovrens
Governor
Greg E.
