i~ <br />• <br />• <br />Minutes, April 24 - 25, 1991 - 16 <br />It was MOPED that the-Board approve Staff's recaiuaendations, regarding <br />assessing a civil penalty against Mr. D. R. Kerrigan, with 32,000 <br />payable within 30 days and the balance payable by the October 1991 <br />Board Meeting. SECONDED AND PASSED UNANIMOUSLY (Jouflas, Cooley, <br />Danielson, Kraeger-Rovey and Entz). <br />This Item was reconvened as a Formal Public Hearing, with all persons <br />wishing to give testimony being sworn, at a later time during this <br />Board Meeting. <br />Mr. D. R. Kerrigan was present and requested that the Board reconvene <br />consideration of this Item, in order to hear his testimony. He <br />discussed the chronology and information presented by R. E. Monks <br />Construction as follows: December 1983-R. E. Monks negotiated a letter <br />of intent to lease the Airport Pit with Mr. Kerrigan; June 1983-Monks <br />signed mining lease and discussed a succession of operator; <br />January 1984-Monks began mining. He answered questions from the Board. <br />It was MOPED that the Board reaffirm its decision arrived at earlier <br />today, regarding this matter. Consideration of possible notice of <br />violation, cease and desist order, corrective actions and civil <br />penalties for mining without a permit. Withdrawn--at Division's <br />. request, because this individual no longer owns the property upon which <br />a possible illegal operation exists.
