i~ • • Minutes, April 24 - 25, 1991 - 16 It was MOPED that the-Board approve Staff's recaiuaendations, regarding assessing a civil penalty against Mr. D. R. Kerrigan, with 32,000 payable within 30 days and the balance payable by the October 1991 Board Meeting. SECONDED AND PASSED UNANIMOUSLY (Jouflas, Cooley, Danielson, Kraeger-Rovey and Entz). This Item was reconvened as a Formal Public Hearing, with all persons wishing to give testimony being sworn, at a later time during this Board Meeting. Mr. D. R. Kerrigan was present and requested that the Board reconvene consideration of this Item, in order to hear his testimony. He discussed the chronology and information presented by R. E. Monks Construction as follows: December 1983-R. E. Monks negotiated a letter of intent to lease the Airport Pit with Mr. Kerrigan; June 1983-Monks signed mining lease and discussed a succession of operator; January 1984-Monks began mining. He answered questions from the Board. It was MOPED that the Board reaffirm its decision arrived at earlier today, regarding this matter. Consideration of possible notice of violation, cease and desist order, corrective actions and civic penalties for mining without a permit (continued from the March 1991 Board Meeting). Consideration of possible notice of violation, cease and desist order, corrective actions and civil penalties for mining without a permit. Withdrawn--at Division's . request, because this individual no longer owns the property upon which a possible illegal operation exists. (See Item 15 for additional discussion).
