Dear Mr. Miller:
On February 28, 1985 the Colorado Mined Land Reclamation Board found Marathon
Gold Corporation in violation of provisions of permit requirements [Rule
8.22(3); CRS 34-32-124(7)]. The CMLR Board also found violation for failure
to maintain adequate financial warranty [Rule 7.3(c); CRS 34-32-117(4)(c) ].
Please refer to the attached Findings of Fact for details concerning the
violations, cease and desist order, corrective action, and civil penalty.
The civil penalty assessed by the CMLR Board was $1 ,000.00 (One Thousand
Dollars) to be paid within 30 (thirty) days.
Concerning the mining versus prospecting issue, this item was continued until
the March 27-28, 1985 Board meeting. The Board requested that a one-page
brief be submitted by Marathon and by the Division stating our respective
positions. This brief should be submitted prior to March 17, 1985. I will be
sending you a letter concerning the Division' s position and suggestions to
remedy this permitting issue.
