' Page 2 • <br />November 8, 1991 • <br />File: M-91-082 <br />In recognition of the need to get on with this project and being <br />confident Mr. Loughrey probably would not want to fund a program to <br />resurvey most of northern Teller County to determine whether the section <br />line that basically defines his north property line is in the right <br />place, we have decided to make some professional assumptions. <br />First, we assume the quarter section corner, identified by a stone <br />monument on an old, very straight and well constructed fence line, i:; in <br />the correct location. Second, we assume this fence represents the true <br />location of the section line and not an unmarked line about 70 feet <br />north of this fence as would occur if the original plat and the <br />Assessor's maps were used. Using these assumptions, based upon Roland <br />Obering's extensive surveying and engineering experience, we will <br />proceed with designing the mining and reclamation plan for Mr. Loughrey. <br />Unfortunately, Mr. Loughrey is currently away and will not return until <br />probably next Monday. He hasn't heard about this problem and probably <br />will not be especially happy to hear he not only purchased an <br />unpermitted gravel pit but he may have also purchased a bit less land <br />than he thought he purchased. <br />In the meantime, we have instructed IntraSearch, who prepared the map we <br />are currently using, to map the various fence lines on top of the <br />topography. This will probably delay preparing the maps a few days, but <br />it will also provide everybody with easily identified ground markers to <br />reduce any future problems of determining what was supposed to happen <br />where. It will also provide us with a clearly defined area around which <br />we can design the plans. Until we have a defined property to work with <br />we really can't design a mining plan because nobody is confident as t~~ <br />exactly what piece of land the permit should include. <br />While the fence lines are being mapped I will be proceeding with <br />drafting as much of the mining and reclamation plans as I can do. Of <br />course, a lot of blanks will need to be filled in that are property <br />dependent. But, at least, work can progress to some extent and that <br />will save time later. <br />I realize this is all very complex and confusing, and even after 21 <br />years of surveying and engineering experience Mr. Obeying is still <br />shaking his head in disbelief that things could be this fouled up. <br />Because the Board does not rule on property line disputes we feel thi:; <br />approach is the only one that can get this process moving toward <br />acquiring a permit for the site. If you have a problem with our <br />approach or have any suggestions as to how this might be handled better, <br />please call. We still feel we can have a permit application in by <br />November 22, but, as I am sure you can understand, the way things have <br />
