i~lii«a iii <br />STATE OF COLORAUv <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: Southway Construction, Inc. ) <br />117 White Pine Drive ) BOARD ORDER <br />Alamosa, CO 81101 ) <br />TO: Southway Construction, Inc. and all other persons engaged in or owning or controlling the <br />following operation: Pathfinder Pit. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Board by C.R.S. <br />3432.5-124, the Board hereby makes the following findings of fact: <br />1. Southway Construction, Inc. is permitted to conduct a mining operation under the terms of <br />Permit M-94113 located in Section(s) 32, Township 42 N, Range 9 W of the NM P.M., in San <br />Miguel County, Colorado. <br />2. The Mined Land Reclamation Board conducted a Formal Public Hearing on August 29, 1996 <br />to consider possible violation of the terms of Permit M-94113 and C.R.S. 3432.5-101 et sea. <br />3. The Division of Minerals and Geology presented evidence at the Formal Public Hearing on <br />August 29, 1996, demonstrating that: <br />A) A moderate sized mud slide disturbed 0.3 of an acre outside the approved permit area. <br />B) The possible cause of the mud slide was a melting snowdrift in combination with a layer <br />of old rotted trees. <br />Q The mud slide did not start within the permit area but did cause a small amount of <br />disturbance in the southwest corner of the permit area. <br />
