S <br />Denver, CO 80203 <br />Re: Pathfinder Pit/San Miguel County/Public Service Company of Colorado <br />Catcems Rc: Slooe Stability and Amcsl3idro llectric Penstock ]ntepsity <br />Dear Mr. Shuey and Ms. Linden: <br />We represent Public Service Company of Colorado ("PSCo") in wnncction with its <br />concerns regarding the stability of certain sections of slope contiguous to the path of'PSCo's <br />Hines Hydro Electric Penstock and also adjacent W certain stretches of haul road included <br />within the pcrmitled arcs for the Pathfinder Pit in San Mibvel County that is operated by <br />Pathfinder Development, Inc. <br />Specifically, in respect of the presently pending enforcement actions involving the <br />Pathfinder Pit that are scheduled for consideration by the Colorado Mind land Reclamation <br />board at iu September 2000 meeting, please be advised that PSCo has retained a consulting <br />gcotechnical engineering firm that will be providing a report concerning the stability of the <br />slope area contiguotte to the PSCo Penstock and the Pathfmder haul road. This geolechnical <br />report will also recommend critically importan[ remedial measures shat need to be taken in <br />respect of the marginally unstable present condition ol't}IC slope in this area. We anticipate <br />submitting this report to the Mind Land Reclamation Board and the Division of Minerals and <br />Cicology on Friday, September I5, 2000.
