Banta. <br />Division Drtector <br />Un January 4, 1990, I requested an administrative review of the Blue Flame <br />Permit pursuant to Rule 5.03.3(b) to determine whether a pattern of violations <br />existed, I noted in the memo requesting administrative review that Blue Flame <br />Coal Company was issued five notices of violation and one cessation order as a <br />result of three separate Division inspections in the 12 month period beginning <br />August, 1988. <br />Compliance problems at the Blue Flame Mine continue, and this fact should be <br />considered in the administrative review. Between October, 1989 and May, 1990, <br />three additional NOY's have been issued as a result of three separate Division <br />inspections. Two of the NOV's were upheld, one is still under appeal. The <br />three most recent violations are listed below: <br />NOV C-89-028 - Failure to have available at a convenient place in the area of <br />t e mTi fining all required records and reports. <br />Issued October 26, 1989 <br />NOV C-89-035 - Failure to implement the surface drainage control plan as <br />approved in technical revision iii. <br />Issued December 26, 1989 <br />NOV C-90-013 - Failure to construct or maintain sediment pond as designed. <br />Issued May 15, 1990 <br />An additional issue of concern is that the operator is overdue in paying the <br />fixed penalty for NOV C-89-035.
