Un January 4, 1990, I requested an administrative review of the Blue Flame
Permit pursuant to Rule 5.03.3(b) to determine whether a pattern of violations
existed, I noted in the memo requesting administrative review that Blue Flame
Coal Company was issued five notices of violation and one cessation order as a
result of three separate Division inspections in the 12 month period beginning
August, 1988.
Compliance problems at the Blue Flame Mine continue, and this fact should be
considered in the administrative review. Between October, 1989 and May, 1990,
three additional NOY's have been issued as a result of three separate Division
inspections. Two of the NOV's were upheld, one is still under appeal. The
three most recent violations are listed below:
NOV C-89-028 - Failure to have available at a convenient place in the area of
t e mTi fining all required records and reports.
Issued October 26, 1989
NOV C-89-035 - Failure to implement the surface drainage control plan as
approved in technical revision iii.
Issued December 26, 1989
NOV C-90-013 - Failure to construct or maintain sediment pond as designed.
Issued May 15, 1990
An additional issue of concern is that the operator is overdue in paying the
fixed penalty for NOV C-89-035. See attached memo from Mike Savage.
