Doughty: <br />This is officiy~l notification of action taken by the Mined Land Rec~:ama ti on <br />on December I7r 1981. Per your request, stated in our telephone conversation <br />of December I8, 1981, the Board continued their consideration of your appli- <br />cation for an indefinite period of time. <br />By law (34-32-320 of the Act) the Board cannot approve this application until <br />you have satisfied the requirements of the June 24, 1981, Board order <br />which seta $4;000.00 civil penalty for this operation. Therefore, this <br />application will not be considered by the Mined Land Reclamation Board until <br />you have paid the $9,000.00 civil penalty. <br />I might add thAt it was my impression that the Board would have appz~oved <br />this application, pending verification of conformance with local government <br />approval (the fetter from Mr. Mutzebaugh), if the civil penalty had be:~n <br />paid. <br />Please send in 'a letter verifying your request for a continuance.
