Natural Resources <br />Your attention is directed to the Colorado Air Quality Control Act, CRS, <br />Sections 25-7-114(1) and (4), which reed as follows: <br />"(1) No person shall permit emission of air pollutants from, or construc- <br />tion •or alteration of a qy facility, process, or activity except residen- <br />tial structures from which air pollutants are, or are to be, emitted un- <br />less rrnd until an air gollutant emissions notice has been filed with t?ie <br />Divis=ion xith respect to such emission. A revised emissions notice shall <br />be filed whenever a significant change in emissions is anticipated or has <br />occurre d. The commission shall exempt those sources or categories of <br />sources which it determines to be of minor significance from the require- <br />ment that an air pollutant emissions notice be filed." <br />"(4) No person shall construct or substantially alter anv building, <br />facility, structure, or installation, except single family residential <br />dxellings, or install any machine, equipment, or other device, or commence <br />the conduct of aqy combinations thereof, or commence operations of arty of <br />the same which rill or do constitute a new stationary source or a new in- <br />direct air pollution source without first obtaining or having a valid per- <br />mit therefor from the division, board, or commission, as the case may be; <br />except that no permit shall be required for new indirect air pollution <br />sources until regulations regarding permits for such sources have been <br />promulgated by the commission. The commission shall establish rules, <br />regulations, and procedures in accordance with the provisions of this <br />article for the granting or denial of permits which shall be in conformity <br />with the purposes of this article, as set forth in Section 25-7-102, but <br />in no event shall regulations governing indirect air pollution sources be <br />more stringent then those required for compliance with the federal act and <br />final nrles and regulations adopted pursuant thereto. Such procedures <br />shall include, but not be Limited to, the following:..." <br />
