Rollings, 370, OSM <br />Janet Binns, DMG <br />Larry Reschke, PCC <br />This was afollow-up inspection to the oversight inspection conducted on 12/3/92. <br />The purpose of this inspection was to address concerns that arose during the <br />oversight inspection that have not been adequately addressed by DMG under the <br />approved state program. <br />NOV 93-020-370-001, TV1, was issued for failure to contemporaneously reclaim <br />waste piles. This is the same violation cited in TDN 92-020-370-003, issued during <br />the oversight inspection. The Colorado rules cited are 4.13, and 4.10.4(5). The <br />abatement measures required are to construct the east collection ditch of CRDA #2 <br />to the approved design specifications in the permit, and to cover the three <br />completed lifts of CRDA #1 and two completed lifts of CRDA #2 with four feet of <br />the best available non-toxic and non-combustible material. The NOV was hand <br />delivered on 2/23/93 to Larry Reschke. I started to explain the appeal rights to Mr. <br />Reschke and he stated that the company lawyers were aware of them and already <br />working on the appeal. The east collection ditch has eroded about 21 inches at <br />the apparent deepest point and has not been protected with a channel lining. The <br />five total completed lifts of the two CRDA piles have not had any cover placed on <br />them. <br />Upon arriving at the mine, I asked for all enforcement actions, modifications, <br />terminations, and vacations that have been issued to address the violations <br />observed during the oversight inspection. The following is what I reviewed: <br />NOV C-92-36 -Dealt with non-coal waste. Issued 12/3/92. Abatement <br />date was 12/10/92. <br />Termination for C-92-36. Issued 12/3/92. <br />NOV C-92-37 -Dealt with access road #6 drainage. Issued 12/3/92. <br />Abatement date was 12/17/92. <br />Termination for C-92-37. Issued 1/13/93; 27 days after the abatement <br />date. <br />
