While the Office of Surface Mining has no record of H-G Coal
Company attending the conference, Mr. Dave Snyder and Mr. Duane Eubanks
represented H-G Coal Company at conference on May 30, 1979. Mr. Eubanks'
and Mr. Snyder's notes from the conference indicate that the Civil Penalty
was reduced to $O. The Office of Surface Mining failed to prepare a
"Conclusion of Conference" report, resulting in the current situation.
The H-G mine is no longer operating, therefore the cost of
conducting an additional assessment conference would not be economical.
However, if the Office of Surface Mining locates the proceedings from the
May 29, 1979 Assessment Conference, we request that they be sent to H-G
Coal Company.
Sincerely,
.~//r ~
R.
