Beaver Av. ) CEASE & DESIST ORDER <br />F L Morgan, Colorado 80701 <br />T0: Builders Aggregate Company, Inc.. and all other persrnis presenCly <br />o~ming or acquiring now or in the future an interest in the sand <br />and gravel mining operation located at S'z NG'--~ of Section 31, <br />T. 4N, R. 57id, Morgan County. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the ?lined Land Reclamation <br />Board by C.R.S. 1973, 34-32-123, as amended, (1976 Sessi.ou Laws, H.B. 1065) <br />the Board hereby makes the following findings of: fact: <br />1. Puilders Aggregate Company, Inc. is operating a sand and gravel mining <br />operation in the following location: 52 NF1,,,~ Section 31, T. 41d, R. 5714 of the <br />6th P.Pt. <br />2'. Sand and gravel operations are required to be permitted by the <br />Board pursuant to the *_erms of Article 32 of Title 32 of 34, C.R.S. 1973, <br />as a:r.ended (1976 Session Laws, H.B. 1065). <br />3. The ?lined Land Acclamation Board has not received any application <br />from Bui..lders ;lggrecate Company, Inc. tot sand and gravel mining and reclamation <br />as of. June I, 1981. <br />4. Builders Aggregate Company, Inc. has not obtained a permit for sand <br />and gravel mining operations. <br />NOTICE OF VIOLATION <br />You are hereby notified that the facts stated above constitute a <br />violation of Section 109 (7), Article 32, Title 34, C.R.S. 1973, as amended. <br />This section provides in pertinent part: <br />An operator shall obtain a development and e>araction permit from <br />the P,oaid f.or each mining operation. <br />'fhe term operator is defined by C.R.S. 1973, 34-32-102 to include; <br />any person, firm, partnership, association or corporation or any department, <br />division, or agency of federal, sCate, county or municipal govermnent engaged <br />in or controlling a mini.no operation. <br />
