GOOD FAITH CERTIFICATION <br />Undersigned counsel has conferred or attempted to confer with counsel for the other <br />parties pursuant to C.R.C.P. Rule 121, Section 1-15(8). The Tatums do not object to this <br />motion, and undersigned counsel did not receive a response from counsel for the Division of <br />Minerals and Geology. Basin Resources, Inc., objects to this motion. <br />In light of this Court's Apri127, 2001, Order Granting Temporary Relief to <br />the Tatums and the findings therein, the Board has determined that the interests of justice and <br />economy of State resources would best be served by reconsideration of the April 10, 2001, <br />order which led to this action. <br />2. In its Order Granting Temporary Relief, the Court found that it has <br />jurisdiction over the Board's April 10, 2001, order. As such, the Board will not be able to <br />reconsider its order unless this Court grants jurisdiction to the Board for the purpose of <br />reconsideration. <br />The Court may remand matters onjudicial review to the board pursuant to § 34- <br />33-128(2), C.R.S. <br />4. The Board has notified all parties that it intends to reconsider the April 10, <br />2001, order at its May 23, 2001, meeting. No party has objected to the Board's <br />reconsideration of its order. Furthermore, all parties have waived their right to thirty day <br />notice under the State Administrative Procedure Act so that the Board may hold a <br />reconsideration hearing on May 23, 2001. <br />
