The <br /> purpose of this letter is to provide to a list of issues that the City of Boulder(the"City")believes are <br /> relevant for the hearing before the Mined Land Reclamation Board on June 25, 1997. In addition, <br /> since there seemed to be some question as to whether the City's initial comments were received in <br /> a timely fashion, I have also attached a copy of our April 22, 1997 letter for inclusion in the record. <br /> All issues raised in that letter are being re-submitted. <br /> List of Issues: <br /> 1. Are the proposed changes to the reclamation plan consistent with the stated use of <br /> wildlife and agriculture? <br /> 2. What are the hydrologic and floodplain implications of the proposed changes to the <br /> reclamation plan? <br /> • Is it appropriate to consider the berth and its flood implications as part of this hearing? <br /> • Does leaving the berm on-site create an unacceptable risk to the health, safety and welfare <br /> of the citizens of this state, and particularly to the neighborhoods north of the site? <br /> • Does increasing the size of the berm create an unacceptable risk to the health, safety and <br /> welfare of the citizens of this state, and particularly to the neighborhoods north of the site? <br /> K:ULPHMCM\AMLL-DMG 2.UX <br />
