It appears that all issues within the
jurisdiction of the Division pertaining to the Rules and Regulations have been clarified or corrected..
An issue in regard modification or issuance of a new Special Use Permit is still under consideration by
Montrose County.
Staff ispleased to inform Mr. Grav that the amendment is approved. The new required Financial
Warranty has been calculated and accepted at $52,653.00. Please submit a rider to bring the current
bond up to this amount or new bond in the total amount. The acceptance of the bond is required to make
the amendment approval final. Prior to any disturbance within this new area, the permitee must supply
the Division with documentation of an approval from Montrose County. A complete copy of the SUP is
not necessary, but some final approval letter will be required. Failure to do so maybe viewed as a
failure to acquire all the required local, state or federal permits as required by Rule. This may result in
Possible Notice of Violation being issued and Board action. As long as the permitee is working on the
County SUP issue to correct it, staff will not take any action at this time.
If you need additional information, please contact me at the Division of Minerals and Geology, Grand
Junction Field Office, 101 South Third Street, Room 301, Grand Junction, Colorado 81501, telephone
no. 970-241-1117.
Sincerely,
G.
