This notice
alleges that the amendment is being made to "...correct a mistake made in 1992 by the Department of Mineral and
Geology for a Hard Rock/Metal Mines Limited Impact (110) reclamation permit ...". The Van Ellas also alleged in
letters dated September 26, 2005 and November 6, 2005 (copies enclosed) that the Division of Minerals and
Geology (DMG) made a mistake in 1992 and that the DMG should write a letter explaining this to the Board of
County Commissioners of Chaffee County. The DMG answered those letters with a letter dated November 14,
2005, explaining that we did not make a mistake in ]992 when the applieaEen-tyres-eeesidered~ tlc eopy ofthisletter
that more fully explains our position in this regard is enclosed.
It has also come to my attention that the secald page of the Notice of Filing Application sent to you by the Van
Ellas states, in part: "The effected bolmdaries have been changed from 3 acre to 9.9 acres and has been approved by
the Department of Mineral and Geology". Please note that the DMG is presently reviewing the application for
amendment and has not approved of said application at this time. Please also note that the DMG did inspect the site
on September 23, 2005 (copy of report enclosed) and took Global Positioning System measurements to determine
acreage enclosed by stakes placed by the Van Ellas. Please refer to paragraph four on page two for a description of
the areas enclosed by the stakes the Van Ellas placed.
If you have any questions regarding this application, please contact me at 303-866-3863.
Si ly,
azl
Senior Environmental Protection Specialist
CC: ,~If: James and Ms. Deanna Van Ella
H.
