M-2001-001 <br />OVER OBJECTIONS <br />THIS MATTER came before the Mined Land Reclamation Boazd ("Boazd") on ~~ <br />October 29, 2003, in Denver, Colorado for aPre-Hearing Conference. The purpostQk}f th€~F`~ C?,~~~ <br />.o~ol~ ps ~~ <br />Pre-Hearing Conference is to identify parties, determine issues, establish a date for the 'oA, ~' <br />°/s . ~~S <br />formal exchange of witness and exhibit lists and to estimate the time for the parties' ph`~<<, <br />scheduled presentations at the.Board's Formal Heazing, as set forth in Colorado Land <br />Reclamation Act for the Extraction of Construction Materials Construction Materials Rule <br />2.7.1. <br />This matter is being heard by the Board as the result of a ruling in a Colorado <br />District Court case, Marilyn Boynton, et al. v. Colorado Mined Land Reclamation Board, et <br />al., District Court Case No. 01 CV3425. In that case, the District Court ordered the Board to <br />conduct a second Pre-Hearing Conference in this matter. <br />This Proposed Pre-Hearing Order ("Proposed Order"), and any amendments thereto, <br />shall be effective upon approval by the Boazd. If any party has objections to the provisions <br />of this Proposed Order, those objections must be raised by a timely motion to the Board or at <br />the final hearing before the Boazd during the Board's deliberations. <br />The Boazd, having considered the parties' presentations and having been otherwise fully <br />informed of the facts in this matter, hereby enters the following Proposed Order: <br />
