Long, Director <br />Division of Minerals and Geology <br />Department of Natural Resources <br />215 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />Re: Division of Minerals and Geology (DMG) August 29, 1995, <br />response to Ten-Day Notice (TDN) 95-020-179-003, Coal Ridge <br />Mine (C-84-065) <br />Dear Mr. Long: <br />This letter acknowledges the Office of Surface Mining Reclamation <br />and Enforcement (OSM), Western Regional Coordinating Center <br />(WRCC), Denver Field Division's (DFD), receipt and review of the <br />subject August 29, 1995, TDN response. This represents DMG's <br />second response to the TDN and follows an August 28, 1995, <br />meeting during which our agencies discussed the issues raised in <br />the TDN. We agreed this second response would provide additional <br />DMG regulatory rational behind approval of the Coal Ridge <br />reclamation plan which we discussed during our meeting. <br />DFD agrees that retention of terraces on the site does not <br />conflict with the regulatory provisions for reclaiming to the <br />approximate original contour. DFD acknowledges the site has the <br />same general surface configuration of the surrounding range land <br />and that all highwalls and spoil piles have been eliminated. <br />DMG's response highlights the three performance standards in Rule <br />4.14.2(2) relevant to terraces which were considered by DMG and <br />addressed by the permittee. DFD understands the permittee has <br />proposed to reduce the existing terrace outslopes where surface <br />water may be a factor to 3h:ly and also armoring those areas. <br />This action will ensure that all terrace outslopes meet or exceed <br />the minimum static safety factor of 1.3. DMG's response also <br />provides justification for approval of terrace benches wider than <br />twenty feet. DMG has determined the wider terraces will ensure <br />additional erosion control and long term stability. <br />
