C-85-040, <br />Dear Mr. Shelton: <br />We have recently been notified that the Board intends to <br />hear the objections of Colorado Yampa Coal Company to the is- <br />suance of the referenced Notices of Violation at its November, <br />1985 meeting. <br />As you may know, I have been the attorney representing <br />Colorado Yampa in connection with their request for a hearing <br />before the Board. Accordingly, Colorado Yampa has indicated <br />to me that they believe it is imperative for me to provide the <br />company with legal representation at the Board hearing on <br />these NOV's. At this time, however, I am counsel for the <br />plaintiff in a two-week jury trial which conunences in the Den- <br />ver District Court on November i8, 1985. Accordingly, I will <br />be unable to represent the company at the presently scheduled <br />hearing date. <br />On behalf of Colorado Xampa Coal Company, request is <br />hereby made that the Division r_ontinue the hearing before the <br />Board on the subject Notices of Violation until the December, <br />1985 Board meeting.
