R-5 <br />EXHIBIT S -PERMANENT MAN-MADE STRUCTURES (6.4.19) AMENDED <br />11-01-06 <br />There exist several man-made structures within the affected lands <br />(property) owned by Gravel, LLC. These primarily are outbuildings that will <br />either be removed or dismantled as mining progresses in this area. The <br />only other structures within 200 feet of the affected lands are those <br />belonging to Keith Fassbender. <br />(a) Attached is a notarized agreement between Keith Fassbender and <br />Gravel, LLC pursuant to this requirement. <br />Revision to Exhibit S 10-27-05 <br />Determination was made by CDMG that the proposed access road is affected <br />land. As such the Williamson residence falls within 200 feet of this proposed <br />roadway alignment. Attached herein is a notarized agreement between James <br />Williamson and Gravel, LLC pursuant to this requirement. <br />Further Revision to Exhibit S 11-02-06 <br />As discussed herein, the proposed access roadway alignment has been revised. <br />The new alignment begins in the same vicinity of County Road 309 as earlier <br />proposed, but now will proceed northward across the former Gundersen <br />property. Gravel, LLC, (applicant/operator) now owns this property including the <br />house located within the property. This structure is within 200 feet of the new <br />proposed road alignment. No other structures are within 200 feet of the amended <br />affected lands boundary. <br />(The following narrative was added 12-20-06) <br />There is no mining proposed in the amended affected area. The house <br />referenced above is 180 feet (horizontally) at the closest point from the proposed <br />top of slope of the new roadway to be constructed. At this point in the roadway <br />alignment the house is approximately 56 feet higher in elevation. Furthermore, <br />the roadway design cross-sections in this area require a minimal amount of cut <br />into the hillside. Thus, the structural stability of the house will not be adversely <br />affected by the construction of the proposed roadway or the use thereof. <br />A geotechnical study of the roadway alignment has been performed and will be <br />submitted along with the final road design plans during the technical review of <br />this amendment request. <br />RECE~~~ED <br />DEC 2 6 2006 <br />Division of Reclamation, <br />Mining and Safety <br />24 <br />
