Earlier this year, we granted two "small area exemptions" for <br />this mine (pursuant to our Rule 4.05.2(3)). Before we can issue such <br />exemptions, the operator mrst demonstrate that the drainage leaving the area <br />will "meet the effluent limitations of Rule 4.05.2 and the applicable state <br />and federal water quality requirements for downstream receiving waters." I <br />have enclosed a copy of our Rule 4.05.2 for your reference. <br />The two portions of the Apex No. 2 Mine for which exemptions were granted are <br />as follows: <br />1. A mine office location, which encompasses about 0.11 acres. This <br />parcel of ground includes an office building, and a graveled border <br />area. The building is outside of the mine drainage control <br />system. Drainage from the building area flows to a county road <br />ditch, which is not part of the mine drainage control system. <br />Drainage to the road ditch is predominately sheetflow. <br />2. A mine fan bench, which encompasses about 0.05 acres. The bench is <br />located on a hill slope, and both the bench and hill slope are well <br />vegetated. Drainage from this bench would pass off of the bench, <br />then down the slope. There is no evidence of concentrated flow <br />leaving the fan bench, and the bench is outside the mine drainage <br />control sy stem. <br />
