~_; <br />? j <br />DE-RL04-96GJ89467 <br />• LEASE AGREEMENT <br />UNITED STATES DEPARTMENT OF ENERGY <br />~a, F ~ <br />THIS LEASE AGREEMENT, entered into and effective this ,~! o day of ~ Hna /f- 199,8; by and <br />between the UNITED STATES OF AMERICA (hereinafter "Government"), represented by the UNITED <br />STATES DEPARTMENT OF ENERGY (hereinafter "DOE) and Oomnman4uealfh Edtson'Comvaiiv whose <br />principal place of business is Chtcaea Ilhnoss (hereinafter "Lessee"): <br />.................................. <br />WJTNESSETH THAT: <br />WHEREAS, the DOE holds certain uranium mining property described in Appendix "A" hereto; and <br />WHEREAS, the DOE desires that said property be developed and operated for the production of uranium- <br />bearing ores; and <br />WHEREAS, this ]ease is authorized by Section 67 of the Atomic Energy Act of 1954, as amended, and is <br />issued pursuant to the provisions of the DOE's regulations governing the issuance of leases for mining deposits <br />of uranium in lands held by the DOE (10 CFR Part 760). <br />• NOW, THEREFORE, the parties do hereby agree as follows: <br />I. GRANT OF LEASE. <br />(a) For considerations hereinafter stated and performance by the Lessee of the terms and conditions <br />hereinafter provided, the DOE does hereby lease unto the Lessee, for the 'purposes of exploring for, developing, <br />mining, and removing deposits of uranium, vanadium, and associated minerals, the property described in <br />Appendix "A", which is attached hereto and hereby made a part hereof, subject to the terms and conditions <br />hereinafter set forth. The rights hereby granted are limited to exploration, development, mining, and removal of <br />ore from within the vertical planes of the boundary lines of the premises described in Appendix "A", and the <br />Lessee shall have no right hereunder to extend its workings beyond such vertical planes. Access to the tract of <br />land leased hereunder is not guazanteed by the Government. The Lessee shall be responsible for securing such <br />access. <br />(b) All requirements, stipulations, and obligations stemming from and associated with the Lessee's <br />activities conducted in accordance with MINING LEASE NO. AT(OS-1~ML-60.8"-SNi=18` are incorporated <br />. herein by reference and are binding to the Lessee under this lease. If conflicts arise between the requirements <br />
