CARPENTER <br />DALE TOOLEY <br />119]3 ~ 1985) <br />As we discussed today, Kerr Coal Co. has completed the regrading work required <br />by the Settlement Agreement dated as of December 8, 1994, among Kerr, OSM and the <br />Colorado DMG. I understand that the DMG and OSM (Mike Rosenthal) inspected the <br />work at the Pit I area on November l4, 1995, and that Mr. Rosenthal was satisfied that <br />the work met Kerr's regrading obligation under the Settlement Agreement. I am also <br />advised that the DMG's report of the inspection, and their evaluation of completion of the <br />Approved Revision called for by the Settlement Agreement, is expected next week. <br />It appears. therefore, that Kerr and OSM are ready to complete the remaining <br />terms of the Settlement Agreement, particularly those set forth in paragraphs 4.b and c, 6 <br />and 8. Below is a checklist of the actions I believe are necessary for your review and <br />comment. All actions should be completed no later than January l5, 1996, when the stays <br />of the various cases terminate. <br />1. OSM must determine whether Kerr has completed the work required by the <br />Approved Revision, which is numbered TR-13. OSM's determination is independent of <br />the DMG's decision on the same question. My understanding is that Mr. Rosenthal has <br />made this determination for OSM informally and that OSM should be prepared to <br />formalize that decision. (See ¶ 4.6). <br />JNl'-l. lZ/lNJ <br />
