Re: Gravel Pit No 23, Permit No. M-85-100, Annual Fee and Report, Notice of
Violation No. M-93-041
Dear County Commissioners :
C.R.S. 34-32-116(3) and (4) , and Permit No. M-85-100 require Baca County to submit
an annual fee and an annual report on or before July 25 of each year. As of this
date, the Division of Minerals and Geology (the "Division") has not received Baca
County' s annual fee of $225.00 and report for July 26, 1992 through July 25, 1993.
Therefore, Baca County is in violation of the above cited statutes and the
provisions of Permit No. M-85-100. Also, be aware that no new permits for mining
operations shall be granted to Baca County (C.R.S. 34-32-120) until the violation
is abated with the State of Colorado. Pursuant to C.R.S. 34-32-124(7) , as amended,
Baca County is hereby assessed a civil penalty in the amount of $225.00.
If Baca County fails to submit the annual fee, annual report, and the assessed
civil penalty by November 30, 1993, this matter will be scheduled for Formal Public
Hearing before the Mined Land Reclamation Board for consideration of a Cease and
Desist Order at the December 15-16, 1993 Board Meeting.
IN ORDER TO AVOID A CEASE AND DESIST ORDER, PLEASE SUBMIT $225.00 FOR ANNUAL FEES,
$225.00 FOR THE CIVIL PENALTY (FOR A TOTAL OF $450.00) , AND THE ANNUAL REPORT BY
NOVEMBER 30, 1993.
The Board Meeting will be held on December 15 and 16, 1993, in Room 318 of
1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m. or as soon thereafter
as the matter can be considered, and Baca County will have the opportunity to be
represented and heard .
