As of this <br /> date, the Division of Minerals and Geology (the "Division") has not received Baca <br /> County' s annual fee of $225.00 and report for July 26, 1992 through July 25, 1993. <br /> Therefore, Baca County is in violation of the above cited statutes and the <br /> provisions of Permit No. M-85-100. Also, be aware that no new permits for mining <br /> operations shall be granted to Baca County (C.R.S. 34-32-120) until the violation <br /> is abated with the State of Colorado. Pursuant to C.R.S. 34-32-124(7) , as amended, <br /> Baca County is hereby assessed a civil penalty in the amount of $225.00. <br /> If Baca County fails to submit the annual fee, annual report, and the assessed <br /> civil penalty by November 30, 1993, this matter will be scheduled for Formal Public <br /> Hearing before the Mined Land Reclamation Board for consideration of a Cease and <br /> Desist Order at the December 15-16, 1993 Board Meeting. <br /> IN ORDER TO AVOID A CEASE AND DESIST ORDER, PLEASE SUBMIT $225.00 FOR ANNUAL FEES, <br /> $225.00 FOR THE CIVIL PENALTY (FOR A TOTAL OF $450.00) , AND THE ANNUAL REPORT BY <br /> NOVEMBER 30, 1993. <br /> The Board Meeting will be held on December 15 and 16, 1993, in Room 318 of <br /> 1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m. or as soon thereafter <br /> as the matter can be considered, and Baca County will have the opportunity to be <br /> represented and heard . <br /> If you have any questions , please contact Barbara Chiappone. <br /> Sincerely, <br /> MICHAEL B.
