L.P., C-81-019 <br />Dear Ms. Crosby: <br />The purpose of this letter is to request an extension to the abatement date for the <br />referenced NOV. The extension is necessary as climatic and ground conditions have <br />precluded full abatement by the date set forth in the NOV. <br />The abatement date for this NOV is set for "May 5, 1995 (when weather and ground <br />conditions permit)". The Division is aware that Colowyo mobilized a track type excavator to <br />the West Pit Pond on April 15, 1995 with the intention of having all of the topsoil removed <br />well before the abatement date. The Division is also aware that after we mobilized the <br />excavator, a series of wet spring storms has passed through the region effectively shutting <br />down the project until conditions dry out. <br />Given the uncertainties of these seasonal weather conditions and the persistence of <br />the perched water conditions found under the slide we would like to request that the <br />abatement date be modified to provide for the full 90 days for abatement as provided in the <br />regulations. Maintenance of the pond will proceed, however, as soon as site conditions allow. <br />In addition, we will continue to monitor the area as prescribed by the Division until <br />such time that the visual markers are removed by the removal of the topsoil stockpile. Most <br />importantly, the movement of the landslide continues to not place the West Pit Pond structure <br />in any jeopardy and the pond continues to perform as designed. <br />Please contact me if you have any questions concerning this matter. <br />Sincerely, n <br />~,"~ G f~' <br />ames A.
