Based upon my review of those letters, the Cedar Heights
lenders will consent to waiver of the 20-day notice, prov:Lded that
the resolution of the HR-6 culvert issue is not considered at the
June 27 and 28, 1990 Board meeting. It does not appear from the
documents which you sent me that that matter will be tah:en up at
that hearing. If my understanding on this matter is incorrect,
please advise immediately. I have discussed this waiver wii:h Brenda
Bartels, attorney for Preferred Savings Association, and she
concurs with the waiver as outlined above.
As discussed during our telephone conversation today; we have
received the report from our engineer regarding the HR-6 culvert,
and copies of that report have been sent to the lenders f'or their
review and comment. I would anticipate submitting our report to
Castle Concrete and the Mined Land Reclamation Board during the
first week of July 1990. I am hopeful that we will be able to
reach a resolution to the HR-6 culvert issue shortly after that
time.
