In that <br />letter, AFO granted the Division fifteen days to complete a review <br />of the bond adjustment which was approved for the Fruita Mine in <br />September, 1990. The Division has completed its review and <br />responded to the operator. This letter is MLRD's response to part <br />2 of 3 of the TDN. <br />An estimate of the cost of reclamation work performed at the Fruita <br />Mine prior to the bond reduction was completed by the Division. <br />The Division estimates that the cost associated with the completed <br />work is $5380. A copy of the Reclamation Cost Summary is enclosed. <br />This $5380 was improperly included in the $51,000 bond reduction <br />granted by MLRD. The bond should have been reduced by $45,620 due <br />to planned disturbance never occurring at the mine. The Division <br />is rescinding the $5380 bond reduction. A copy of notification to <br />the operator is also enclosed. <br />In order to process this action, the Division proposes the <br />following approach, as outlined in the enclosed letter to the <br />operator. This approach is possible and seems most reasonable at <br />this time because the Division has processed but, not accepted a <br />Phase I bond release subsequent to the bond reduction addressed in <br />the TDN. <br />
