The Division <br />has requested documentation, including the date, that mining operations have been reinitiated or that <br />reclamation was begun, in accordance with Section 34-32-103(13) of the Colorado Mined Land <br />Reclamation Act. <br />Operations at the West Sunday Mine, Permit No. M1981021, were most recently conducted in 1999, not <br />1993 as noticed in the Division letter of May 1, 2006. The following materials are attached as <br />documentation for the most recent period of operations at the West Sunday Mine: <br />1. Notice of Intent to Resume Operations sent by Certified Letter, May 30, 1997, from the Operator to <br />Mr. Wallace H. Erickson at the Division's Durango, CO Office. <br />2. Notice of Intent to Continue Mining Operations, Annual Report, dated April 21, 1998. Mine operations <br />were resumed during February 1998. <br />3. Annual Report, dated April 22, 1999, noting ongoing mine operations. <br />4. Annual Report, dated June 15, 2000, noting that mine operations continued through May 1999. <br />5. Annual Report, dated May 11, 2001, stating that the West Sunday Mine remains on standby-ready <br />status (entered temporary cessation of operations in 1999). <br />These statements provide documentation that the West Sunday Mine, Permit M1981021, was last active <br />in 1999, not 1993 as stated by the Division.
