The Board has jurisdiction over this matter pursuant to Sections 34-32.5-104, 34-32.5-105 <br />and 34-32.5-124 of the Colorado Land Reclamation Act for the Extraction of Construction <br />Materials, Section 34-32.5-101 et seq. C.R.S. (2005) ("Act"). <br />5. The Operator submitted a timely application to the Division, but the Division determined the <br />application was incomplete. The Operator now requests an additiona130 days, until August <br />16, 2006, to obtain the Section 110 permit application approval from the Division. <br />6. Based on the evidence presented and on the Division's recommendation, it is appropriate for <br />the Board to grant the Operator's request for an extension of 30 days to August 16, 2006. <br />ORDER <br />Based on the foregoing findings of fact and conclusions of law, the Board hereby approves the <br />Operator's request fora 30-day extension of time, or until August 16, 2006, to obtain an <br />approved Section 110 reclamation permit from the Division. <br />DATED this /~l ~ day of ~~ , 2006. <br />FOR THE COLORADO MINED LAND RECLAMATION BOARD <br />~,-- S ~ ~~ <br />Ira J.
