Trupp Attorney at Law 455 Dodge Street Delta, Colorado 81416 Re: Hallenbeck Pit No. File No. 77-62 (Please change your files from improper reference to 77-63. ) Dear Mr. Trupp: At approximately the time of your submission of Letter of Credit No. A0192, our reclamation specialist, William R. Beavers left our employ. I am now completing the last of his unfinished tasks. The succession of operations from Hallenbeck Construction, Inc. to Benson Brothers for the above captioned operation is one such task. I have reviewed the file and the items submitted by you, to date and find that further action is needed before our Board can approve the succession of operators to your client, Benson Brothers. The succession of operators form, the performance warranty, and the Letter of Credit itself are all correct as to form and thus, acceptable. In order to complete the warranty package, a financial warranty form to accompany the Letter of Credit must also be submitted for Benson Brothers. I have enclosed a blank form for your use in this regard. This form can be filled out much as was the already submitted performance warranty. Our Division has recently begun to also request that a new operator fill out a new application form. the form itself needs to be filled out for the new operator ( in this case, Benson Brothers) in order to allow us to have the requisite administrative information for the succeeding operator. I have also enclosed a blank application form for this purpose. There is one final problem which should be resolved at this time, if possible. The approved amount of the financial warranty for this operation is presently $2,500.00. I note that Letter of Credit No. A0192 is for $2,600.00. A rider to the Letter of Credit could probably correct that. However, the fact that the Letter of Credit is for too large a sum does not invalidate it for the purposes of the succession of operators. The problem goes beyond this, however, since the maximum amount of financial warranty for a limited impact permit such as this has been raised to $5,000.00 since the permit was approved and issued for this operation. For an operation of this size (8.32 acres) , it is Division policy to recommend that the financial warranty be increased by the Board during the succession of operators process.
