Trupp <br /> Attorney at Law <br /> 455 Dodge Street <br /> Delta, Colorado 81416 <br /> Re: Hallenbeck Pit No. File No. 77-62 (Please change your files from <br /> improper reference to 77-63. ) <br /> Dear Mr. Trupp: <br /> At approximately the time of your submission of Letter of Credit No. A0192, <br /> our reclamation specialist, William R. Beavers left our employ. I am now <br /> completing the last of his unfinished tasks. The succession of operations <br /> from Hallenbeck Construction, Inc. to Benson Brothers for the above captioned <br /> operation is one such task. I have reviewed the file and the items submitted <br /> by you, to date and find that further action is needed before our Board can <br /> approve the succession of operators to your client, Benson Brothers. <br /> The succession of operators form, the performance warranty, and the Letter of <br /> Credit itself are all correct as to form and thus, acceptable. In order to <br /> complete the warranty package, a financial warranty form to accompany the <br /> Letter of Credit must also be submitted for Benson Brothers. I have enclosed <br /> a blank form for your use in this regard. This form can be filled out much as <br /> was the already submitted performance warranty. <br /> Our Division has recently begun to also request that a new operator fill out a <br /> new application form. the form itself needs to be filled out for the new <br /> operator ( in this case, Benson Brothers) in order to allow us to have the <br /> requisite administrative information for the succeeding operator. I have also <br /> enclosed a blank application form for this purpose. <br /> There is one final problem which should be resolved at this time, if <br /> possible. The approved amount of the financial warranty for this operation is <br /> presently $2,500.00. I note that Letter of Credit No. A0192 is for <br /> $2,600.00. A rider to the Letter of Credit could probably correct that. <br /> However, the fact that the Letter of Credit is for too large a sum does not <br /> invalidate it for the purposes of the succession of operators. The problem <br /> goes beyond this, however, since the maximum amount of financial warranty for <br /> a limited impact permit such as this has been raised to $5,000.00 since the <br /> permit was approved and issued for this operation. For an operation of this <br /> size (8.32 acres) , it is Division policy to recommend that the financial <br /> warranty be increased by the Board during the succession of operators <br /> process.
