The Board.in its order required that the application be submitted by no later than <br />October 1 and that all operations at the pit cease. Since we have now submitted the 112 <br />application I request that you ask the Board if the cease and desist order could be changed to allow <br />for sales of materials from existing stockpiles. <br />I am making this request on behalf of a few small operators who rely on the pit for materials to <br />build leach fields and repair roads to gas well sites. On the average before the cease and desist <br />order we sold about 500 tons of material a month. The pit owners daughter operates the scale on <br />an as needed basis when these small contractors need material. The amount revenue we eam is <br />very small from such sales. U fact we are still selling materials from the processing we did in <br />1988. There is only one other pit in the Grand Mesa and it is a long haul from it to the Molina <br />area. <br />In ~~ew of eur quick response to the order for [he l 12 application I hope the Board will give <br />favorable consideration to our request. We will conduct no mining nor any processing until the <br />112 application is approved. Our request only involves the removal of existing stockpiled <br />materials.
