is-, <br />The Honorable Robert Uram -2- September 9, 1994 <br />The DMG staff member requested a copy of the final WSC reports, and the AFO inspector stated <br />that the reports were considered internal memoranda; therefore, the reports could not be released. <br />The AFO inspector indicated that this opinion would be verified with his supervisor, but no further <br />word was ever received from the AFO. <br />Finally, during Mareh of 1994, the DMG Coal Program Supervisor contacted the WSC to obtain <br />the WSC reports, and the reports were faxed to the DMG on March 3, 1994. At no time prior to <br />March 3, 1994 did any AFO or WSC personnel provide specific concerns regarding achievement <br />of AOC at the Kerr Coal Co. mine, nor do the WSC reports provide any conclusive finding that <br />achievement of AOC at the Marr Mine is a problem. Regardless, DMG access to the specific <br />relwrts generated by the WSC was denied by AFO staff. <br />The August 25, 1994 letter also indicates that the OSM was not aware that the reclamation had <br />been initiated during the summer of 1993. The DMG monthly inspections reports for the period <br />following May 1993 clearly indicate that the reclamation was occurring.
