En°R <br />Hayden, CO 81639 Dlvuinn Direcl°r <br />RE: NOV C-95-008 Abatement, Seneca Coal Company, <br />Seneca II W Mine, Permit No. C-82-057, <br />Dear Mr. Altavilla: <br />In your letter dated 4 j24 j95 you state that permit perimeter markers along the Tie <br />Across Haul Road (TAHR) have been repeatedly removed from locations where <br />cultivated fields overlap the permit boundary. Presumably, these markers are being <br />removed by farm equipment operators not associated with Seneca mining operations. <br />You have proposed, for the areas where cultivated fields overlap the TAHR permit <br />perimeter, that permit perimeter markers be located as near to the actual permit <br />boundary as possible without entering the cultivated area. <br />During our phone conversation on 5/3/95, I indicated that your proposal was acceptable <br />to the Division. Please submit your proposal as an minor revision (MR) for inclusion <br />into the Seneca II W permit. <br />The original abatement requirement for NOV C-95-008 was to place markers as required <br />by the Rules and permit by 4/30/95. The Division received your letter on 4/26/95. <br />Please find enclosed, an NOV extension of the abatement deadline to 5/19/95 to allow <br />time for submittal and approval of the MR requested above. <br />Please contact me if you have any questions or require additional information. <br />Sincerely, ~/ <br />Wallace H.
