.' ' ~, <br />E. Good Faith <br />At the time the NOV was written, the area was still <br />undergoing snowmelt after a record April where over 4 inches of <br />precipitation fell on the minesite. As noted in the May 20, 1992 <br />letter to the Division, Colowyo noted that on May S1 an attempt was <br />made to enter the area but the equipment (a D-lON dozer and 16G <br />motorgrader) became stuck. In addition, a May 16 cloudburst dumped <br />an additional 1.5 inches of moisture onto the area in 25 minutes. <br />Colowyo's reclamation dozer (a D-7 dozer) then broke down <br />and a D-6 dozer had to be rented to address the problem areas. The <br />earliest possible date to complete a ditch above the topsoil to dry <br />out the area was May 26 at which time the ditch was completed. <br />As conditions allowed, the D-6 dozer's sole job was to <br />complete the construction of the dozer cuts and other work <br />resulting from the May 16 storm. By early June all of the work was <br />completed. <br />Based upon the facts that Colowyo rented equipment <br />specifically to correct the problems, abatement was achieved in the <br />shortest time possible given the wet soil conditions and before the <br />expiration date. Colowyo respectfully requests serious <br />consideration for a Good Faith reduction. <br />Colowyo intends to discuss the issues contained herein at <br />the Assessment Conference on August 17, 1993.
