<br />NOV CV-98-008 <br />Rimrock Mine <br />This NOV was issued for failure to maintain liahility insurance required by the regulations and, <br />failure to maintain mine records at or near the mine and, failure to submit an annual reclamation <br />report. <br />HISTORY <br />No NOV's have been issued at this site during the past twelve months. No penalty is assessed <br />for history. <br />SERIOUSNESS <br />Liability insurance is required by the regulations as a means of protecting the public from potential <br />damages caused by coal mining. Public records are required to be available at or near the mine <br />so that the public has an opportunity to be aware of and participate in the mine permitting <br />process. Failure to comply with these regulatory requirements precludes the public from the <br />opportunity to participate in the permitting process and makes them potentially more exposed to <br />impacts from mining. $250 is assessed for a low level of seriousness for this violation since none <br />of the potential impacts appear to have occurred. <br />FAULT <br />The operator was negligent in not maintaining insurance and public records specifically required <br />by the regulations. $250 is assessed for a low level of negligence. <br />GOOD FAITH <br />There is no evidence of extraordinary efforts required or taken to abate this NOV. No credit for <br />good faith is granted. <br />102898 <br />
