3-20-95; t:OOAM; SENECA COAL t9~02~630t4 # 3/ 3 <br />ENEC <br />coaicompanr Seneca Coa ompany <br />December 4, 2003 <br />Ms. Sandy Brown <br />Division of Minerals and Geology <br />1313 Sherman St <br />Denver, CO 80203-2273 <br />Dear Ms. Brown: <br />RE: 110V CV-2003-014 Rill and Gully Stabilisation Work <br />8eaeoa 2W Miae G82-057 <br />Please consider the following points as you review this NOV: <br />Seneca's 2W permit states the survey and map for rills is to be completed by June 1 and the repair work <br />to be completed by Nov. 1 or until weather conditions restrict operations. <br />• Survey and map work was completed by June 1. <br />• Stabilization work had begun on the rills as necessary, per our plan. <br />• On Oct. 31 Seneca 2W mine received a major snowstorm. <br />• Wark on the rills and gullies was stopped because of the wet conditions. <br />CDMG Regulations require rills and gullies to be stabilized when they are large enough to interfere with <br />post mine land use or successful revegetation. We have identified the areas that need additional work <br />along with the areas that Dan Matthews noted in his inspection on 8-5-03. <br />Since compliance with 4.14.6, Regrading and Stabilizing rills and gullies, is subject to individual <br />interpretation and we were in compliance with our permit (page 34, Tab 22, Vol. 13) -a violation is sot <br />warranted. <br />We plan to continue the stabilization work as soon as possible and the submittal of a plan to remove the <br />contour ditches within the time frame Mr. Matthews requested. <br />Please review this notice of violation in light of this information.
