BOARD ORDER <br />Based upon the foregoing Findings of Fact and pursuant to C.R.S. 34-32-123(2) <br />the Mined Land Reclamation Board hereby assesses a civil penalty in the amount <br />of $2,050.00 This is based upon an assessment of $50.00 per day for 41 days <br />of violation, from August 7, 1991 to September 18, 1991. The Board hereby <br />suspends $1850.00 if all corrective actions items are complied with by the <br />established deadline dates. Should the corrective actions not be complied <br />with, the $1850.00 suspended portion of the civil penalty will be due on <br />October 11, 1991. The Board orders the unsuspended portion of the civil <br />penalty in the amount of $200.00 to be paid to the Mined Land Reclamation <br />Division within 30 days of the signature date of this document.' <br />In clarification of the rights of recipients of Notices of ~liolation, Cease <br />and Desist Orders, parties are advised to consult the Colorado Mined land <br />Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts <br />to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are <br />advised to consult C.R.S. 24-4-106, as amended. <br />Dated at Denver this ~~day of ~.~-,e"f-e~...-~~,~, /~S~ <br />MINED LAND RECLAMATION BOARD <br />COLORADO DEPARTMENT OF NATURAL RESOURCES <br />DAVID L BUCKNAM, Acting Director <br />Mined Land Reclamation Division <br />BK/yjb <br />8320E <br />
