Exhibit H -Wildlife Information and Exhibit C Mine Plan Maps <br />a) A review of the mine plan maps shows a 200 foot setback from the mining limits to <br />the South Platte River, but also shows disturbance boundaries which are much closer <br />to the river, in some areas possibly as close as 20 to 30 feet, including the location of <br />topsoil/overburden stockpiles. In the comment letter from the Colorado Division of <br />Wildlife (DOW), dated January 21, 2005, it is stated, '7n order to protect the <br />riparian area and the diversity of large and small mammals, birds, and herptiles that <br />inhabit the site, a 200' setbackfrom the western shoreline of the river is <br />recommended. It is also recommended to keep as many of the mature cottonwoods <br />as possible, and leave snags where feasible. "Please submit a plan to leave a 200 <br />foot undisturbed riparian corridor between the disturbed area and the riverbank and <br />describe how this area will be protected from any accidental disturbance. Also <br />describe what number (or areas) of mature cottonwoods will be protected and how <br />they will be protected. It has been shown that groundwater dewatering can kill <br />cottonwoods. Will the operator take measures to prevent the killing of cottomvoods <br />through groundwater dewatering? If so, please describe these measures. <br />The maps have been revised to reflect a 200-feet undisturbed riparian corridor between <br />the disturbed area and the riverbank. Lafarge will use T-posts to stake the 200-feet offset <br />to clearly define the limits of disturbance and to ensure protection of the riparian <br />corridor. Lafarge will not directly disturb cottonwoods within the 200-feet corridor and <br />will use water from dewatering operations and perforated pipe to water the cottonwoods <br />while the pit is dewatered. <br />b) A copy of the January 21, 2005 DOW comment letter is enclosed. Please respond to <br />their concerns regarding: <br />i. Bald Eagle winter night roosts <br />Lafarge is coordinating efforts with DOW representatives and wildlife <br />consultants to identify the exact location of potential eagle roosts. Lafarge has <br />met with both DOW and USFWS at the site; mitigation measures are being <br />developed. <br />ii.
