7. The shop building was removed and the entire shop/yard area covered with topsoil <br />and reseeded. Successful revegetation has been confirmed through field inspection. <br />Rockcastle has complied with Section II, Part 4 of the Agreement. <br />8. Rockcastle used its discretion for the sequence of reclamation activities specified <br />Section II, Part 5 of the Agreement. Rockcastle has complied with Section II, Part <br />5 of the Agreement. <br />9. Since execution of the Agreement, deadlines for completion of reclamation activities <br />were extended with the concurrence of the Division. Rockcastle completed all <br />required reclamation activities on or before April 27, 1993. Rockcastle has complied <br />with Section II, Part 6 of the Agreement. <br />10. The Division received a letter from the landowner (formerly Bogle Farms) on June <br />26, 1990 requesting pit access roads be retained. In conjunction with this request, <br />original access road width was maintained. Rockcastle has complied with Section III, <br />Part 1 of the Agreement. <br />11. Appendix D submitted by Rockcastle to the Division on November 26, 1991 <br />demonstrates compliance with Rule 4.05.2 (Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining) for Ponds 2 and 3. Rockcastle responded to <br />additional concerns of the Division on May 13, 1992. Rockcastle has complied with <br />Section III, Part 2a of the Agreement. <br />12. Rockcastle submitted information to the Division as required to retain ponds 4 and <br />5/6 as permanent impoundments as required by Rule 4.05.9(1). This information <br />was received by the Division on November 26, 1991 and May 13, 1992. "As built" <br />certifications were received for ponds 4 and 5/6 on November 20, 1992. Rockcastle <br />has complied with Section III, Part 2b of the Agreement. <br />13. Rockcastle submitted engineering studies to the Division on October 4, 1990 and <br />February 6, 1991 that addressed the stability of Pits 5 and 6. Map R-1 represents <br />final post-mining topography for Pits S and 6. Upland diversion ditches for Pits 5 <br />and 6 were eliminated during reclamation work occurring in 1992. No additional <br />reclamation activities were required by the Division after review of these studies. No <br />unstable areas have been identified to date within Pits 5 and 6. Rockcastle has <br />complied with Section IV, Part 1 of the Agreement. <br />14. Rockcastle identified unstable sections on the Pit 4 haul road. Remedial activities, <br />including installation of buttresses and toe drains to stabilize the Pit 4 haul road, <br />were accomplished in 1992 as required under the approved reclamation plan. Road <br />drainage modifications were also completed. Aggregate was imported from offsite <br />to complete these activities. Rockcastle has complied with Section IV, Part 2 of the <br />Agreement. <br />2 <br />
