(Page 2) MINE ID # OR PROSPECTING ID # M-1986-104 INSPECTION DATE 3!5/03 INSPECTOR'S INITIALS GRM This inspection was preformed as part of the normal Financial Warranty Update program established by the Colorado Division of Minerals and Geology. The Montgomery Pit Financial Warranty was last updated in 1993. DMG documents show that the update under taken at that time was for reclamation of Stage 2 only, The inspector was accompanied on site by B & B Representative Jason Burkey. B 8 B Construction has continued to remove scrap iron, old equipment and other undesirable debris from this site. DMG photo documentation shows a marked improvement in the overall appearance from the past. The only equipment and structures left on site are all portable and therefore do not need to be considered in the Financial Warranty Update. The Mining and Reclamation Plans approved for this site were for a phased operation That entailed reclamation of mined out areas as the operator progressed into others. There is some reclamation noted on the west end where slopes are close to the final approved 2H:1 V slope. However, this appears to be the extent of the reclamation efforts to date. The south highwall is currently 1H:1V or slightly better for an estimated 1350 feet at around 40 feet in height. Of the total acreage within the permitted area an estimated 4 to 6 acres on the east side are all that remains to be mined and undisturbed. Therefore the Division must estimate the current reclamation costs on the total area of the permit rather than the original phasing. The fact that the approved Plans were not followed is listed as a PB with a Corrective Action Date noted on the following Page. This issue was not raised in the 2002 inspection because staff did not have the permit to review at that time due to a data imaging project within the Division. There appears to be some vegetation on the west slope and on the upper reaches of the soil stockpiles along the south highwall. No trees as required by Eagte County or the Division were noted. Vegetation consisted of some rabbit brush, sagebrush and various grasses. The vegetation along the west side appears to be around 60 % cover. The south area cover is in an area that will be disturbed to establish the required slopes. The original Financial Warranty was based on a phased operation. Because no reclamation of significance has been undertaken, DMG must bond for the total disturbance of the permitted area. The Financial Warranty issue is being listed as a PB with a Corrective Action date on the following page. In an effort to ensure the financial warranty remains adequate to reclaim this site per the requirements of the approved reclamation plan, DMG has updated the reclamation cost estimate (copyenclosed). Clearly, the site is currently under-bonded. Therefore, pursuant to Section 3432.5-117(4) of the Colorado Land Reclamation Act, adequate financial warranty must be submitted to DMG within 60 days of the mailing date of this report. Please review the enclosed figures as soon as possible and Contact our office if any calculation errors are noted. No other issues were noted at this time.
