<br />-2- <br />l_i <br />(g) Snowmass shall implement its plan to separate any ground water <br />flows in the B-seam workings from those in the No. 1 Mine A-seam <br />workings, by 'means of underground seals or dams such that flow from the <br />B-seam workings will not enter into such A-seam workings. The B-seam <br />portal will be sealed in a manner sufficient to withstand the hydraulic <br />pressures present and disallow drainage to the surface. Snowmass shall <br />submit a revision to its MLRD permit for this purpose. <br />Paragraph (h) addresses the operator performing a study to determine if <br />diversion of surface inflow into the B-seam workings is practicable. If such <br />discreet surface water inflow points do exist, it would be prudent to divert <br />such flows. However, such points may not exist and if they do, maintenance <br />free diversion may not be possible. I propose that this study is not required <br />for the abatement if the rewrite as suggested of (g) is accepted. I also <br />propose that such a study and diversion would not constitute abatement of the <br />violation without the elements of Paragraph (g). <br />Paragraphs (i) and (j) will need to be rewritten to incorporate abatement as <br />proposed in (g). <br />srs <br />4234E <br />
