RE: Abatement Extension for NOV C-91-013 Beyond 90 Days, Somerset Mine, (File No.
C-81-22)
Pursuant to Rule 5.03.2(2)(c), we are requesting that the Director extend the abatement
deadline for NOV C-91-013 issued to the Somerset Coal Mine, from November 3 to
November 14, 1991. This will extend the abatement deadline beyond 90 days and will
require the approval of the Division Director.
Rule 5.03.2(2)(c)(i) states that an extension beyond 90 days may be granted:
Where the permittee of an ongoing permitted operation has timely applied for and
diligently pursued a permit renewal or other necessary approval of designs or plans
but such permit or approval has not been or will not be issued within 90 days after
a valid permit expires or is required for reasons not within the control of the
permittee;
As an abatement to the violation, the Division required that the mine submit a technical
revision and have it approved by November 3, 1991. However, the Division's proposed
decision to approve the revision issued October 23, 1991 has been contested during the
public comment period and a hearing before the Mined Land Reclamation Board has been
scheduled for November 13 and 14, 1991. Since the Board will issue the final decision
during the November Board hearing; an extension to the abatement period is requested to
this time.
