. <br />BEFORE THE DEPARTMENT OF HEALTH <br />DIVISION OF ADMINISTRATION <br />STATE OF COLORADO <br />• ~~III~~I~~I~~~~~~I~ <br />sss <br />NOTICE OF VIOLATION AND CEASE AND DESIST ORDER AND CLEAN UP ORDER <br />IN THE MATTER OF: TELLURIDE GRAVEL, INC. <br />NO CDPS PERMIT <br />SAN MIGUEL COUNTY, COLORADO <br />TO: Telluride Gravel, Inc. <br />Pursuant to the authority vested in the Division of Administration of the Colorado <br />Depaztment of Health ("the Division") by 25-8-301 to 308, C.R.S. (1989 Repl. Vol. 11A and 1992 <br />Supp.), which authority has been delegated to me by the Executive Director of the Department, 1 <br />hereby make the following Findings of Fact and issue the following Notice of Violation and Cease <br />and Desist Order: <br />FINDINGS OF FACT <br />1. Telluride Gravel, Inc. ("Telluride Gravel") owns and operates a sand and gravel <br />extraction operation ("the operation") located in San Miguel County, Colorado. <br />2. Prior to September 30, 1992, treated wastewater associated with [he operation was <br />authorized to be discharged from sediment ponds, subject to specific limitations, under Colorado <br />Discharge Permit System ("CDPS") Permit No. COG-500000 ("the permit"), which was effective <br />on November 30, 1987 and expired September 30, 1992. Telluride Gravel was covered under <br />facility number COG-500217 between December 16, 1991 and September 30, 1992. The permit <br />expired on September 30, 1992. Telluride Gravel did not apply for permit renewal. <br />3. The permit authorized discharge from outfall 001 which is the discharge of dewatering <br />water to the San Miguel River from a series of settling ponds. <br />4. Pursuant to the requirements of the permit, Telluride Gravel was required to sample and <br />analyze the effluent being dischazged at outfall 001 monthly. The results of the analysis were <br />required to be submitted to the Division in annual reports. Telluride Gravel did not collect and <br />analyze the samples for outfall 001 as required and submitted a blank discharge monitoring report <br />for outfall 001 on November 17, 1992 for the period of December 16, 1991 through September 30, <br />1992. <br />5. Pursuant to the requirements of the permit, the discharge monitoring report is due 28 <br />days after the end of the reporting period. The reports for the permit which expired on September <br />
