OCT-IB-OT 10:53At1 FROIFRL <br />\ J <br />+303 866 5385 <br />T-042 <br />potential water quality issues related to toxins honied from earlier operations, the Division <br />notes that it has inspected the Coaldale Quarry 18 times since the permit was issued in the <br />1970s. There is no indication in any of the inspeerion reports or in the permit file that <br />in~oduced toxins are buried on the property. ?'his quarry operated beginning early in the <br />20ei eentttry, so it cannot be ruled out that there are pollutants buried on the site, but there <br />have been no environmental indications that this has occurred. The proposed mine plan <br />does not include any excavation of the currently reclaimed waste rock dumps, so if there <br />are historic wastes buried therein, they will not be re-disturbed. <br />12. '! lte weight of the evidence demonstrates that the Applicant has met the minimurn <br />requirements of Mule 3.1.6. <br />13 In addition to the Division's blasting stipulation, described above, the Division also <br />recommends that permit amettdment approval be conditioned upon a stipulation requiring <br />the Applicant to add Mountain Mahogany to the seed mix at a rate of 0.8 pounds pure <br />live seed per acre. That stipulation, set forth in the "staff Recommendation to Approve," <br />is part of the administrative record and is explicitly incorporated herein by reference. <br />14. Based on the specific responses to issues raised by the Objectors, as set forth above, and <br />based on the Division's recommendation, it is appropriate for the Board to approve the <br />Applicant's application for a Section 112 Reclamation Permit Amendment. <br />ORDER <br />Based on the foregoing facts and conclusions of law, the Board hereby approves the <br />Applicant's application for a Section 112 Reclamation Permit Amendment with the two <br />Division-recommended stipulations described above and incorporated herein by <br />reference. <br />Ho]cim/Coaldale, M-1977-247 <br />
