We believe <br />there Is Information In the permit document, as well as historical and related technical and circumstantial <br />informiation your office should consider respective of the Division's position pertaining to language in the ' <br />permit: the Division ai present is attempting to enforce. Additionally, there were no temporary measures th~t <br />could be techntcaliy effected on the ground as requested try the Division. We would like to present this <br />information to you at the time of the meeting. <br />Specifically, we believe there Is language in the permit that contradicts the language the Division is present~y <br />focused on in its NOV. Given full consideration of the facts In context, we believe there is sufficient <br />justification for the Division to rescind its letter. Conversations with Tom Schreiner, yesterday, seem to <br />suggest that this information may not have been presented to your office in part, or in whole. Additionally; <br />there :are technical considerations that belie the prudence of executing such language on the ground if <br />enfora°d by the Division. <br />We are! earnestly attempting to satisfy the Division's concerns that have led to the recent Amendment, and; <br />related concerns of the Division expressed In Its Inspection reports, and by correspondence to the Division <br />from our neighbor's. We want to assure the Division of our appreciation for your efforts to consider the ,A <br />eomple;xity of the matters at hand, as we entertain any reasonable compromise to effect a viable solution -7 <br />this 2D year old problem which our company inherited from our predecessor. We believe we have that <br />solution, and subsequent to the Division's concurrence, stand ready to effect it iri the field. <br />We arev available to meet at your earliest convenience. Circumstance rop hibits us from mt;eting on the <br />following dates: July 8 and 12-13. Any other date is presently open. Please let us know what other dates !will <br />work for you and your staff, and we will be there at the time specified.
