A "Notice of Proposed Amount of Civil Penalty" for NOV C-94-004 was
recently mailed to you from our office. When that proposed penalty
was assessed, I proposed no penalty for history, incorrectly
indicating that no NOV's had been issued at the Foidel Creek Mine
during the past twelve months. In fact, three NOV's were issued
during the past year. The enclosed materials include a corrected
notice of proposed civil penalty. Only the history component and
the total amount of proposed penalty have been changed. The
remainder of the document is the same as the original.
Please disregard the previous notice and replace it with the
material enclosed here. If the request for informal conference in
the original package has already been mailed to the Division we
will arrange a conference based on that request. There is no need
to complete a second form, if a conference is desired. I
apologize for any inconvenience this may have caused.
