Cattany <br />Division Direttor <br />Natural Resource Trustee <br />DRMS completed the preliminary adequacy review of your application for Amendment No. 1 (AM-01) to Permit No. <br />M-1977-424 for the Logan Wash mine site. The application cannot be approved until the following issues are <br />adequately addressed. Please submit a response to the following issues as soon as possible, but no later than <br />12:00 Noon on December 4, 2006 so the decision due date set for 4:00 p.m. December 4, 2006 can be met. If you <br />cannot respond by 12:00 Noon on December 4, 2006 please submit a written request for extension of the decision <br />date. If your response, or an extension request, are not received by 12:00 Noon on December 4, 2006 this <br />application may be denied. DRMS apologizes for the late date of this adequacy review. <br />ADEQUACY ISSUES <br />1. Please either submit BLM approval of the plan to weld the covers on the manholes or revise the <br />reclamation plan to provide for removal of the manhole collars to a minimum 2 feet below ground <br />surface, backfill the hole with inert fill, replace topsoil and revegetate per the plan specifications. <br />2. Please include a commitment to submit results of TCLP tests on the manhole sump sediments, <br />evaporation pond precipitate, and pond/pipeline water (if any to be disposed of) and secure DRMS <br />approval of methods for disposal, prior to initiating clean-up and disposal operations. <br />3. Please provide proof of publication and mailing of notices to all landowners on or within 200 feet of the <br />proposed affected area. <br />4. All maps must be signed and dated by the qualified preparer. <br />5. Please submit either a demonstration that the retort water will be decontaminated enough to meet <br />applicable surface water and/or ground water standards, within 5 years of this date or submit a <br />proposed plan of action to either decontaminate the retorts or prevent (or at least minimize) water from <br />contacting spent shale as it passes through the retorts. <br />6. Please submit specifications and costs for acquisition (lease or purchase), installation, operation, and <br />removal of a treatment facility for the retort water discharge. (including periodic sludge removal, or filter <br />pack replacement and disposal). The time frame for the water treatment bond to be required is the <br />estimated 5 years it will take to complete reclamation and revegetation of the Logan Wash site. The <br />Colorado Department of Public Health and Environment (CDPHE) has jurisdiction over the quality of <br />water that may be discharged from a treatment plant throughout the period of the plant's operation.
