Brighton has recently purchased a 35-ears parcel, legally described as <br />Roadgate Farms No i, Lot 1, near Hendorson In Adams County, Colorado. This parcel <br />has received approval as a sand and gravel rmne to be reclaimed for water storage under <br />DMG 112 Reclamation Permit No. M-2001-OSS. The Seller bas executed as agreement <br />with the City to remove the mineral resources firm this historic mine, to provide a clay <br />liner in accordance to DMG's requirements and to deliver the reoLrimed parcel to t]ie City <br />for water slnrage, <br />During the DMO and Adams County permitting processes, the Seiler has apparently <br />sought approval of different access routes to the mine site from both pemuttlug <br />authorities. Now tha Belles and the City are anxious for mining activity fA begin but <br />understaAd that the mining operator does not have as access route to the site that has been <br />approved by both the DMG and Adams Cotmry. <br />An September 6, 2002, the Seller was inforared by telephone by your office that approval <br />of as alternate access route to the 124s` Hstates Site fivm 120m Avenue could occur only <br />byway of a permit amendment, oRart a three to fottr month process. t3uforittnately for the <br />City, the Seller wan less than prudent with their timing for the alternative access routes <br />regaest, although this in no way excuses their error,. it would certainly create sn <br />unexpected dolay for Brighton. The City is counting on delivery in 2003 of the water <br />storage capacity that this mining site represents; we are exploring ways to shartxn this <br />permit modification process. <br />
